The Labour Delegates are being asked to
decide that the Labor Members of Parliament in Parliament abstain from voting in
favour of the ratification of the Treaty that establishes a Constitution for the
European Union.
Abstain and explain why they are going to unite with the Nationalists to vote
“YES”.
We should not vote “YES” with the Nationalists because the new EU
Constitution says without any hesitation that the Constitution is supreme and
prevails on the Constitution of Malta.
When the EU Constitution says so, we shall be insulting our Constitution if we
vote “YES”.
We
should not be accomplices with the Nationalists in this betrayal of the Maltese
Constitution. That is why we should abstain.
Till now there is nothing in the European Union treaties that put the European
Union above and superior to our Constitution.

If
the Labour members of the Opposition do not unite with the Nationalists in
Government to vote “YES”, there will not be a two-thirds majority in favour
of what the EU Constitution states that it is superior to the Constitution of
Malta.
Thus
it could not be said by anyone that the Maltese Parliament overturned what the
Constitution of Malta provides that no law (and the EU Constitution is a law),
can be against what is provided in the Maltese Constitution.
We are insisting that the Labour members of parliament should abstain and not
vote “YES” to the new EU Constitution because when they abstain they would
not be voting “YES” for the agreement that the Nationalists made with the
European Union in 2003 that the new EU Constitution is renewing.
We should not vote “YES” for that disadvantageous and damaging agreement for
the people, especially for the workers due to all its negative aspects.
We
do not vote for that agreement because in November 2003 we bound ourselves that
while we take part in all the EU institutions, we work tirelessly to stop all
its negative aspects when we vote “YES” to it as it is renewed in the new EU
Constitution.
We should not vote “YES” for the new EU Constitution because it is giving
many more powers to the EU than it has today.
When
the Convention to draft the new Constitution for the Union was set up, it was
said that this had to reduce the powers that the Union had taken from the
governments of the Union member countries.
But not only this did not happen but the Constitution that was drafted and that
we have before us gives many more powers to the EU.
It is not enough for the EU that its new Constitution gives it more power.
Because this new Constitution also introduces a new power that states that where the Union finds that it lacks some power to achieve its aims, the EU Council of Ministers can agree to give the Union that power required which does not exist in the new Constitution.
Thus no one can say what is the limit of powers that the Union is going to have if its new Constitution enters into effect.
It
is our duty not to say yes for this great abuse that there is in the
Constitution that is to be presented in the Maltese Parliament.

It the Nationalist Members of Parliament do not care about passing more powers
to the Union that the Maltese people trusted in their hands, when they elected
them in Parliament, we the Labourites should be jealous and protect the rights
of our people to democratically control with its vote how the powers of the
management of our affairs are used.
That is why we should not vote “YES”, but should abstain and explain why we
are doing so.
We should not vote “YES” for the Constitution if there are any doubts about
it or lack of agreement about its meaning and how it hits our people.
It is useless to say what we understand what the new Constitution says.
After all, what the new Constitution states is decided by the Court of Justice of the European Union. This is inclined towards the union and not to what the member countries say and want.
Neither is it better for us from the point of partisan politics to vote YES with the Nationalists, as they want us to do.
Already
the majority of the people gave their trust to the Labour Party because it
promised to work to stop the disadvantages and all that causes damage in the
agreement that was made with the European Union.
This majority will be lost if we now vote YES for the agreement that we bound
ourselves to change.
The more time passes and we come nearer to the general election, the majority of
those who are hit by the disadvantages and the damage of the 2003 agreement
grows bigger and increases, and therefore the Labour Party will win once it
appears that it is determined in what it had promised, and not if it appears to
be yielding.
