The great challenge that the Labour Opposition has in Parliament is whether it should go against the Constitution of Malta and vote in favour of the European Union Constitution.

Because
those Labour Parliamentary Members who vote in favour of the new European Union
Constitution will be voting for the Constitution of Malta (made on the strength
of a Labour Government), does not remain supreme in Malta on all the laws that
bind us.
They
will be voting in favour of the European Union Constitution which states that
the laws that the European Union makes are superior and prevail over the
Constitution of Malta.
It was because of this great challenge that the Labour Party has before it that
prior to the last Labour Annual General Conference the Labour veteran Karmenu
Sciberras, from Ħal-Għargħur, and myself, moved a motion that
says that the General Conference decides that the Labour Opposition in
Parliament should not vote in favour of the European Union Constitution that
states that the laws made by the European Union are superior and prevail over
the Constitution of our country.
This motion, which was not presented before the Annual General Conference
because the Party decided to discuss the issue of the European Union
Constitution after the elections for the Local Councils, is going to be
presented before the Labour Extraordinary General Conference that is to be held
in the middle of this year.
After
the Labour win of 12 March, the Party should have more courage that it has the
popular support to implement that which the Labour General Conference decided on
9 November 2003.
At the time the Labour Conference bound the Labour Party so that even while it
is in opposition, to work ceaselessly to overcome all the negative aspects of
the membership agreement that the Nationalist Government made with the European
Union and to see that the agreement with the European Union shall not be
disadvantageous and damaging to the
Maltese people, especially the workers.
The
majority obtained by the Labour Party on 12 March agreed with the decision of 9
November 2003 of the Labour General Conference.
The Labour Parliamentary members who vote in favour of the new European Union
Constitution shall be going against that decision of the Labour General
Conference of 9 November 2003 because the European Union Constitution is
renewing the Agreement, with all its negative aspects, that the Nationalist
Government made with the EU.
They
shall also be approving the put aside the declaration on the neutrality of Malta
that the Maltese Government made with the agreement that the new Constitution
leaves out.
The Labour Parliamentary Members who vote in favour of the European Union
Constitution shall also be voting in favour of the undermining of the welfare
state built by Labour governments.
Because
the new European Union Constitution binds us to implement the neo-liberal policy
that reduces the social services and pensions provided by the State
The Labour Parliamentary Members who vote in favour of the European Union
Constitution shall also be voting against our country continuing with the policy
of neutrality and active work for peace.
Because the European Union Constitution forces us to take part in a military
alliance and follow a common security and defence policy built on the
militarization of the European Union, that also includes the nuclear arms of
France and England.
If the Labour Parliamentary Members do not agree with the Nationalist Government
Members to betray the oath that they took to be loyal and faithful to the
Constitution of Malta, the ratification of the new European Union Constitution
will not be made by a two-thirds majority of all the Parliament and the
Constitution of Malta will remain supreme and the Labour Party will maintain the
right to fight against all that the European Union makes that will be against
that which our Constitution provides.
