The
prime Minister wants the Labour Opposition in Parliament to vote with the
Government in favour of the ratification of the Constitution of the European
Union.
The
Government has a majority in Parliament to pass the motion for the ratification
of the Constitution.
With a simple majority of 35 Nationalist deputies, the Maltese Parliament can
ratify the new EU Constitution and there is no need for the votes of the Labour
Opposition for ratification to be made.
Therefore one should question why does the Prime Minister want the Opposition to
agree with the Government on the European Union Constitution?
If the Prime Minister had genuinely wanted the country to be united on the
European Union Constitution, he would have sought to discuss it before he went
to sign it in Rome on 29 October last year.
Instead of doing so, he went to sign it without having the decency to give the
opportunity to Parliament to discuss it.
He had all the time to do so, because he had already agreed to it in June last year during the Brussels Summit of the leaders of the European Union member countries.
Neither at the
time did he have the decency to give the Maltese Parliament to discuss the
proposals that were being discussed prior to agreement being reached on the
final text of the European Union Constitution.
Once the prime Minister signed the European Union Constitution, the Ministers
and all the Nationalist Members of Parliament were all going to have to vote in
its favour, even if they did not agree totally with it.
Therefore there is not going to be a real discussion ob the European Union Constitution on the side of the Nationalist Members of Parliament.
They are going to have to only speak in its favour, without criticizing it, even
though in their hearts they know that there are many things in it to criticize.
The discussion in Parliament on the new European Union Constitution is only going to be a formality from the Government side.
Therefore why does the Government want the Opposition to agree with it on the
European Union Constitution that it has already approved and signed?
The reason is one and the government doesn’t want to say it.
The government knows that notwithstanding that the Maltese Parliament will
ratify the European Union Constitution, as long as this ratification is made by
a simple majority, the Maltese Constitution shall remain in force and binds the
Maltese courts as the Supreme law and shall overcome the laws that the European
Union makes, if they are not in conformity with the Constitution of Malta.
But if the
Maltese Parliament ratifies the European Union Constitution with a two thirds
majority of all the Parliament (by qualified majority), then it can be said that
the Maltese Parliament had agreed with a qualified majority, as is required by
the Constitution of Malta, that if the European Union makes laws which do not
conform with the Constitution of Malta, those laws will be supreme and overcome
the Constitution of Malta.
Therefore the Prime Minister is insisting for the Labour Opposition to agree
with the Government on the European Union Constitution
He wants the Labour Opposition to be an accomplice with the Government in the
betrayal of the constitution of Malta.
He
wants the company of the Labour Deputies to make a sin and go against their oath
of loyalty that they took to be loyal and faithful to our country’s
Constitution.
Is there any reason that the Maltese people accept the European Union
Constitution that in its Article 6 states that the laws made by the European
Union are superior and supreme on the Constitution of Malta?
Perhaps another chair, the sixth one, in the European Parliament of 750
seats?
This
will be useless compared to the Constitution which unites us as a people – the
only thing that we all agree with.
The Labour Opposition should know that the day after the Maltese Parliament with
a two-thirds majority votes in favour of article 6 of the European Union
Constitution which states that the laws of the European Union are more supreme
than the Constitution of Malta, the Prime Minister will turn on the Opposition
and tell it that it cannot now not accept that an amendment be made to the
Constitution of Malta so that it shall not continue to state that it is the
supreme law of the country.
Thus the Nationalist Government shall have succeeded in destroying the
constitution of Malta that the Labour Government had so much worked for
thirty-one years ago, also with the consent of the majority of the Nationalist
Parliamentary Deputies at that time.
