The Labour Opposition should abstain – Campaign for National Independence CNI
The
Chairman of the Campaign for National Independence (CNI)
Dr Karmenu Mifsud Bonnici said that the Labour Opposition should abstain from
its vote in Parliament about the European Union Constitution.
He
said that it is the duty of the Labour Party to work to denounce the agreement that
the Government made with the EU in 2003, even though it is in the Opposition.

When
he was addressing a press conference with a reaction to the three reports
published by the Labour Party, Dr Mifsud Bonnici said that whoever is going to
vote for this constitution would be voting for this agreement, but the Labour
Party can not vote in favour by abstaining.
The vote for the EU Constitutional treaty is going to pass for the simple reason
that the Government has a majority in Parliament.
But here, it should be the duty of the Labour Opposition, said Dr Mifsud Bonnici, not to let the EU Constitution be superior to the Maltese Constitution.
He
said that according to Article 6 of the EU Constitution, the laws made by the EU
and which are in the EU’s competence are superior to the laws of the EU
members.
But according to Section 6 of the Constitution of Malta, any law which is
inconsistent with the Constitution of Malta is without effect and therefore,
unless the Maltese Constitution is changed, section 6 continues into effect and
any EU law that is not suitable to Malta cannot enter into effect in our country
and therefore, the Constitution of Malta will be superior toe the EU
Constitution.
If the Labour Opposition does not vote in favour, the ratification will be
passed with the vote of the Government Parliamentary Members with simple
majority and not with two thirds of the Parliament.
Thus, The Maltese Constitution will remain superior to that of the EU.
As regards the three reports published by the Labour Party, Dr Mifsud Bonnici
said that two of these reports, although ready last October, were only presented
in March notwithstanding that five months had passed, the reports have many
mistakes, among them of re-numeration.
As regards the report by Dr Edward Zammit Lewis, which is about how the
discussion about the ratification is developing in the EU member countries, the CNI
Chairman said that this report says nothing about our country and therefore did
not comment on it.
On
the report by Dr Joe Brincat and Dr Pawlu Lia which spoke about the legal
implications, Dr Mifsud Bonnici said that according to information that he has,
this report was prepared by Dr Joe Brincat only.
He
continued that in this report there are also some points which no longer apply
and legal points that are not precise, but notwithstanding this he approached Dr
Brincat to inform him about this, and notwithstanding that he sent him a list of
mistakes that there are after Dr Brincat had asked him to indicate where they
were, the Labour Party published the report with its original mistakes.
As regards the political report prepared by Dr George Vella, he said that this
report was presented as an analysis made by the Labour Party, but at the vary
last part it is written that this is the personal opinion of the person who made
the report.
He
continued to say that whoever says that he had discovered something by saying
that the member countries laws have primacy is wrong because it has already been
established by the
EU’s European Court that the EU laws are superior and
prevail over the laws made by national parliaments.
He
said that who made this report cannot vote in favour, but can abstain because in
his report he states that there should be approval of the constitution with
certain reservations.
Dr Karmenu Mifsud Bonnici also mentioned how the Government left out a number of
declarations that were made during the Malta’s negotiations for membership in
the EU.
Among these declarations were that of neutrality and that about the Gozo region.
Dr Mifsud Bonnici asked how can one vote in favour of the Constitution that left
out two so important declarations.
He said that the EU policy is not a neutral policy, and therefore does not tally
with our country’s policy and therefore our country cannot agree with the
foreign policy.
The
CNI President ended the conference by saying that with these three reports
another one should be prepared that gives contrary arguments to the reports
conclusions.
