The
Chairperson of the Campaign for National Independence, Dr Karmenu Mifsud Bonnici,
clearly said during a press conference held yesterday morning that he shall
continue to try to persuade the majority to abstain when it is time to vote in
the General Conference of the Labour Party about the European
Constitution.
Dr. Karmenu Mifsud Bonnici made reference to the decision by the Labour Parliamentary group to decide to vote in favour of the European Constitution and emphasized that the decision of the Labour Parliamentary Group is not the decision of the Labour Party because this will become known during the Labour Party General Conference in which the delegates vote.
He
reiterated that the Campaign for National Independence (CNI)
does not agree with the decision of the Labour Parliamentary Group.
Dr.
Karmenu Mifsud Bonnici referred to the discussion being held in the Labour Party
about the European Constitution and said that the Labour Party is organizing
‘assemblies’ to discuss it.
He said that he attended three of these assemblies, although in one of them there was some opposition.
He insisted that the opposition was not from the Labour Party Leadership but from some delegates.
He
repeated that in these assemblies he is criticizing the position taken by the
Labour Parliamentary Group, while others are defending the position take by the
Parliamentary Group.
Dr
Mifsud Bonnici explained why the Campaign for National Independence (CNI)
does not agree with the position of the Labour Parliamentary Group, among them
that if ratification is not made by a qualified majority no one could argue that
the ratification of the Treaty that establishes a Constitution for Europe would
overcome those articles of the Maltese Constitution that can only be changed by
two thirds or more of all the Parliamentary Members that vote for their changes.
He said that among those articles of the Maltese Constitution that can only be
changed by a two thirds or more majority, there is Article 6 that states that
the Constitution of Malta is supreme and prevails on all laws in Malta.
He
emphasized that unless Article 6 of the Maltese Constitution is not considered
as having been overturned by a qualified majority of the Treaty that establishes
a European Constitution, any law made by the European Union that would be
inconsistent with the Maltese Constitution, will be worthless and will no have
effect in Malta.

The CNI Chairperson said that a point mentioned by the Labour Parliamentary Group and which CNI does not agree with is that when it is said that there is no difference between the Athens Treaty and the European Constitution.
He
said that Article 37 of the European Constitution gives power to the governments
of the member countries to increase the powers of the European Union.
He repeated that “as the CNI we do not agree with the Parliamentary Group when it said the in the European Constitution there are enough safeguards to protect the neutrality policy.
We
do not agree with this because Articles 41.7 and 43.1 puts an obligation on
every member to send help to any member of the European Union which had been
attacked, to participate in military help and to intervene by means of action in
a third country that would have been attacked by a terrorist attack.
As CNI
we do not agree that the Labour Party votes in favour of the Constitution
because this document leave out two important declarations on neutrality and on
Gozo.
Dr. Karmenu Mifsud Bonnici emphasized that the same Labour Parliamentary Group
had voted against the ratification of the Athens Treaty and therefore, if they
are now going to vote in favour of the European Constitution they would be
overturning the previous position they had taken.
He remarked that in the Labour Party General Conference there are going to be
two motions, one encouraging the delegates to vote in favour of the European
Constitution and another to abstain.
