Why the Labour Opposition should abstain (2)

If the Government was really Nationalist, not only figuratively, then it would itself will see to it that the ratification is not made with a qualified majority (that is, with two thirds or more) of the Maltese Parliament, so that while the European Constitution is approved, the supremacy of the Constitution of Malta will also be saved.

 

If the Labour Opposition really wants to protect the national interests of the Maltese people, it must ensure that the ratification of the European Constitution is only by a simple majority so that the European Union laws will not be supreme over the Constitution of Malta (as they are pretended to be by the European Constitution).

For no reason and under no excuse is it acceptable for Labourites who still treasure our beliefs that the interests of the Maltese people come first and foremost, that we vote in favour of the declaration of principles found in Article 6 of the European Constitution, that states that the laws of the Union shall be supreme over our Maltese Constitution.

Neither the majority that voted against the Labour Party and in favour of the Nationalist agreement with the European Union, had voted in favour that the laws of the Union will be supreme more than the Constitution of Malta. 

 

Because this was not an accepted principle and still is today not accepted and shall continue not to be accepted if the Labour Opposition does not vote in favour of the European Constitution by abstaining when it is brought before the Maltese Parliament.

If the Nationalist Government is ready that without the people’s mandate, accept that the laws of the European Union will be supreme more than the Constitution of the people of Malta, the Labour Opposition should not be part of this betrayal of our Constitution. 

 

It is certain that the Labour Opposition cannot say that it would be accepting the will of the majority. Because we have never had a majority of the people that had ever voted for such a thing. 

 

Once the Labour Opposition abstains, this anti-national principle shall not enter into effect in our country.

 

It does not make any difference if the new principle that the laws of the European Union will be supreme more than the Constitution of Malta is written in a Constitution of in a Treaty. 

 

The objection of the Labour Party should be in the principle itself not for the document, treaty or constitution, which contains the principle.

We should not let them impress us by saying that if the Labour Party does not vote in favour of the European Union laws being supreme to the Constitution of Malta, then the Party will be considered that it is against membership. 

 

It is very easy for the Labour Party to deny such a false fib.

 

Membership in the Union does not mean that the Union laws be supreme over the Constitution of your country. 

 

Neither is it today when our country is a member in the Union.

 

In the first place it should be said that, if the European Constitution had to enter into effect, just the same our country remains a member in the Union.
 
In the second place, when the Labour Opposition abstains, it will be assuring that, while the European Constitution is going to be ratified by the Maltese Parliament, the Constitution of Malta will remain protected and supreme in our country.


More than having to defend itself, a Labour Opposition that abstains, would have the opportunity to attack the Government that it did not defend the national interests by accepting the principle that the Constitution of the Maltese does not remain supreme.
